Facing a Foreclosure Sheriff Sale in Passaic County, NJ?

Passaic County holds its foreclosure sales on Tuesdays at the county courthouse on Hamilton Street in Paterson. And it publishes something most counties do not: an absolute deadline. Adjournment requests are not accepted after 2:00 p.m. on the day of sale. Not late, not almost — not accepted.

How a Passaic County sheriff's sale works

New Jersey foreclosure law is the same in all twenty-one counties. The sale itself is not — each county sheriff sets its own schedule, its own location, its own adjournment procedures and its own deadlines. These are Passaic County's.

How to postpone a sale in Passaic County

This is the one thing to take away from this page. Passaic posts the following notice on its sale listings, in capitals:

“The Sheriff’s Office will NO LONGER Accept Defendant Adjournments or 3rd Party Bidders Registering for Sales after 2:00 P.M. on Tuesdays, Day of Sale.”

And separately: “The Stay of Sheriff’s Sale Applications will NOT be Accepted after 2:00 P.M. on the Date of Sale.”

Under state law you are entitled to two adjournments of up to 30 days each, for a $28 fee each time. But that right only exists if you exercise it before Passaic’s cutoff. If you miss Passaic County’s administrative cutoff, your options become much more limited and the situation becomes urgent. Speak with a qualified New Jersey foreclosure attorney immediately to determine whether court relief or another legal remedy may still be available in your specific case.

New Jersey law provides for up to five sheriff-sale adjournments under N.J.S.A. 2A:17-36 — up to five of up to 30 calendar days each — two at your request, two at the lender's, and one by mutual agreement. The $28 fee is set by N.J.S.A. 22A:4-8. How each county administers this varies, which is why the county details above matter.

What if the Passaic County sheriff sale already happened?

If your property has already been sold at sheriff's sale, don't assume there is nothing left to discuss. New Jersey has a limited post-sale redemption period, and depending on your circumstances, other legal rights or options may still need to be evaluated quickly.

I missed the 2:00 p.m. cutoff. Is it over?
It means the Sheriff’s Office can no longer adjourn it for you administratively. It does not automatically mean the sale is final or that you have no options — there is still a short redemption window after a sale, and a court can act in some circumstances. But this is the point at which you need a New Jersey foreclosure attorney, today, not a website. Call one immediately.
How much does an adjournment cost in Passaic County?
State law sets the fee at $28 per adjournment, and allows you two. Passaic does not publish its own separate fee schedule, so confirm the current amount and accepted payment form when you call the Foreclosure Unit.
